SMS/Text Messaging Terms

Service Description

Servo provides automated SMS messaging for field service businesses regarding appointments, service status, and work completion. This is a transactional messaging service, not marketing.

Consent Required

Before receiving any messages, you must opt-in through one of these methods:

  • Checking a consent box on a web form
  • Providing verbal consent during a phone booking
  • Signing a written consent on paper forms
  • Texting START or similar keywords to our number

Message Frequency & Charges

Message frequency varies based on your scheduled services (typically 2-5 messages per appointment). Messages include appointment reminders, arrival notifications, and service completion confirmations.

Standard message and data rates may apply according to your mobile carrier plan.

Opt-Out Instructions

You can opt out of SMS messages at any time by:

  • Replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE to any message
  • Emailing hi@servohq.com with your phone number

Supported Carriers

Our SMS service is compatible with major carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, and others.

Message Delivery

While we strive for reliable message delivery, we cannot guarantee delivery due to carrier issues, device compatibility, or network conditions.

End-User License Agreement (EULA)

License Grant

Subject to your compliance with these Terms, Servo Software, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Servo platform solely for your internal business purposes in accordance with these Terms.

License Restrictions

You may not:

  • Sublicense, sell, lease, rent, or distribute the Service or any part thereof
  • Use the Service to develop a competing product or service
  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, disassemble, decompile, or attempt to derive the source code
  • Remove or alter any proprietary notices, labels, or marks
  • Use the Service for benchmarking or competitive analysis purposes

Non-Compete and Non-Circumvention

During the term of your subscription and for a period of twelve (12) months thereafter, you agree not to:

  • Directly or indirectly develop, design, produce, market, sell, or provide any software, application, or service that is substantially similar to or competes with Servo
  • Use any proprietary information, trade secrets, workflows, processes, or methodologies learned through your use of Servo to create a competing product
  • Solicit, recruit, or hire any Servo employees, contractors, or consultants for the purpose of developing a competing product
  • Circumvent, or attempt to circumvent, Servo's relationships with its customers, vendors, or partners
  • Use data, insights, or analytics obtained through Servo to inform the development of competing services

Competitive Use Prohibited

If you are employed by, affiliated with, or acting on behalf of any business that provides workforce management, field service management, scheduling, dispatch, or similar software services, you may not access or use Servo without prior written consent from Servo Software, Inc.

Violation of this provision constitutes a material breach of this Agreement and may result in immediate termination and pursuit of all available legal remedies, including injunctive relief and damages.

1. Acceptance of Terms

By accessing or using Servo, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use Servo. By using our service, you represent that you:

  • Are of legal age to form a binding contract
  • Have the legal capacity to enter into these Terms
  • Are not prohibited by law from using our services
  • Will provide accurate and complete information

3. Account Registration

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Service Description

Servo provides workforce management software including:

  • Field service task management
  • Manager-worker communication tools
  • Client notification via SMS
  • Reporting and analytics
  • Third-party integrations

5. Acceptable Use Policy

You agree not to:

  • Use the service for any illegal purpose
  • Send spam, unsolicited messages, or marketing without consent
  • Violate any applicable laws or regulations
  • Transmit viruses, malware, or harmful code
  • Interfere with or disrupt the service
  • Attempt to gain unauthorized access to any systems
  • Impersonate any person or entity
  • Harass, abuse, or threaten other users
  • Resell or redistribute the service without permission

SMS Compliance Required

You must comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable carrier guidelines. Failure to comply may result in immediate service termination.

6. Intellectual Property

Servo Software, Inc. owns all content, features, and functionality of the service. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks without written consent
  • Reverse engineer or decompile the software
  • Remove any proprietary notices or labels

7. User Content

You retain ownership of content you create through Servo. However, by using the service, you grant Servo Software, Inc. a worldwide, non-exclusive, royalty-free license to use, store, and process your content for service provision and improvement.

8. Privacy and Data Protection

Your use of Servo is subject to our Privacy Policy. We are committed to protecting your personal information and complying with applicable data protection laws.

9. Payment Terms

For paid services:

  • You agree to pay all fees according to your selected plan
  • Fees are non-refundable unless otherwise stated
  • We may change fees with 30 days advance notice
  • You are responsible for all applicable taxes
  • Non-payment may result in service suspension

10. Third-Party Services

Servo integrates with third-party services (such as Twilio for SMS). These services have their own terms and privacy policies. Servo Software, Inc. is not responsible for third-party services or content.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We specifically disclaim warranties regarding:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content
  • Uninterrupted or error-free service

12. Limitation of Liability

SERVO SOFTWARE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the service.

13. Indemnification

You agree to indemnify and hold harmless Servo Software, Inc. from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • SMS messages you send through the platform

14. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Non-compliance with SMS regulations
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Any other reason at our discretion

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

16. Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

17. Changes to Terms

We may modify these Terms at any time. Changes will be posted with an updated "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the modified Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Servo Software, Inc. regarding the use of our service.
